CONFETTI PRIVATE SPACE RENTAL AGREEMENT & REGULATIONS

This agreement dated the date of booking of a Private Space Rental (including, but not limited to “Patio Party!”, “Inside Party!”, or “Outside Party!”) between Confetti LLC, a District of Columbia Limited Liability Company and the person(s) making payment (“Private Space Renter”) for the rental of Confetti at 4545 42nd St NW #109 Washington DC 20016 (“Space”). The date this contract references will take place on the date specified at the time of booking and will begin 30 minutes before the listed time to allow for set up and will end 30 minutes after the listed time to conclude clean up, unless the parties determine and agree in writing to an alternate date and time. By executing this Agreement, all Private Space Renters and their guests assent and agree to comply with all of the following policies and procedures of Confetti, as set forth herein. The policies, procedures and this agreement may be amended from time to time at Confetti’s sole discretion.

Rate, Deposit and Overtime:

The rental rate for the space shall be the amount listed at the time of booking and must be paid in full no less than 7 days prior to the beginning of the event.

If the rental goes over the scheduled non-hosted party time by more than 15 minutes, the Private Space Renter agrees to pay $150.00 per half-hour or $300 per hour. If the rental goes over the hosted party time by more than 15 minutes, the Private Space Renter agrees to pay $200 per half-hour or $400 per hour.
This amount shall not be pro-rated.
The Private Space Renter and all guests must completely vacate the premises within the 15 minute grace period from the end of the contracted time to avoid automatically incurring the fees outlined above.

Food and Beverage:
1. Outside food and beverages are expressly prohibited without advance written agreement from a representative of Confetti LLC.
2. Foods from our catering menu must be ordered and paid for 7 days in advance of your event to guarantee availability and avoid late fees.
  1. Foods and beverages from our catering menu ordered and/or paid for less than 7 days in advance of your event are subject availability and will incur a 25% service charge.
  2. Foods and beverages from our catering menu ordered and/or paid for less than 4 days in advance of your event are subject availability and will incur a 50% service charge.
  3. Foods and beverages from our catering menu ordered and/or paid for less than 24 hours in advance of your event are subject availability and will incur a 100% service charge.
3. Foods and beverages from our standard cafe menu provided for the private rental must be pre arranged with Confetti 48 hours prior to the event to qualify for a 10% discount for the private space rental.
4. Alcoholic beverages are expressly prohibited from being served and/or consumed on the premises.
  1. The Private Space Renter agrees to pay any fines issued by local or federal agencies due to violation of this policy.

Party Add-Ons:
1. Party add-ons including, but not limited to decoration packages, party favors, premium activities, and private party hosts must be requested and paid for 7 days prior to the party.
  1. Party add-ons ordered and/or paid for less than 7 days in advance of your event are subject availability and will incur a 25% service charge.
  2. Party add-ons ordered and/or paid for less than 4 days in advance of your event are subject availability and will incur a 50% service charge.
  3. Foods and beverages from our catering menu ordered and paid for less than 24 hours in advance of your event are subject availability and will incur a 100% service charge.

Decoration:

Nothing may be hung on the walls or ceiling without the express, written permission of Confetti.

Damage & Cleaning: Any excessive damage done to the Confetti premises or to the Space or other Confetti property shall be billed to Private Space Renter for either replacement or repair.
1. In the occurrence of an additional mess – as determined by the Confetti management or staff – created or done by the Private Space Renter or any of its guests (children and adults included) resulting in extra cleaning of the Space, Confetti premises or other Confetti property shall result in Private Space Renter to be charged an additional $50.00 non-refundable cleaning fee.
2. Any additional damage to the Confetti premises, the Space or other Confetti contents or property created or done by the Private Space Renter or any of its guests (children and adults included) shall be charged to the Private Space Renter accordingly.
3. Confetti cleans and sanitizes its toys, property, Space, premises and other property (including bathrooms) on a consistent basis. Private Space Renter and all party guests must ensure that they dispose of all waste materials such as diapers, paper towels and trash in the correct receptacles provided by Confetti.

Personal Property:

Confetti, its agents and employees are not responsible for the Private Space Renter or any of its Party Guests personal property. It is the sole responsibility of each person entering into the facility to be responsible for all possessions and belongings unless pre-arranged with Confetti and/or its staff. Under no circumstances shall Confetti, its agents or employees, take responsibility for any lost, stolen, missing or damaged personal property or otherwise.

Safety:

Private Space Renter and the parents of the guests are completely responsible for the well-being and behavior of their minor child while on the Confetti premises, the Space or other Confetti property.

Indemnification:

The Private Space Renter agrees to hold harmless and indemnify Confetti, its officers, directors, employees, and agents (collectively, the "indemnified Parties"), from and against any and all losses, costs, expenses, including but not limited to, reasonable attorneys' fees, claims, actions, demands, damages incurred by or asserted against the indemnified Parties by reason of the acts, omissions or negligence of the Client, its guests, employees, agents or independent contractors, arising out of or in any way connected with the Private Space Renter’s event (Private Party), except when directly caused by the gross negligence or willful misconduct of the Indemnified Parties.

Cancellations:

Any adjustments in reservations schedule shall be made 5 business days in advance or result in an additional $25.00 cancellation fee, unless Private Space Renter can provide proof of medical emergency, family emergency or other emergency circumstances. Neither party shall be responsible for changes in reservation schedule resulting from circumstances around COVID public health orders, including government mandated closures or quarantining due to COVID exposure.

Default: Failure by the Private Space Renter to timely pay Confetti all amounts due shall constitute a default by the Private Space Renter. Upon a default by the Private Space Renter, Confetti, at its sole discretion, may:
1. terminate this contract and retain all amounts paid to Confetti as liquidated damages, or
2. enforce the terms of this contract through any and all remedies that it has as defined in this contract.

In no event of default shall Confetti be liable to the Private Space Renter for any amount in excess of amounts paid to Confetti. Said payment constitutes the Private Space Renter’s sole and exclusive remedy and the Private Space Renter hereby relinquishes any and all causes of action, which the Client otherwise have in law or in equity as defined in this Contract.

Applicable Law and Construction. The laws of the District of Columbia shall govern the validity, performance and enforcement of this Lease.

Arbitration: By executing this agreement, Confetti and the Private Space Renter agree that any dispute or claim arising under or with respect to this Agreement will be resolved by Arbitration in District of Columbia before an arbitrator chosen by agreement of the Parties. Each party shall equally bear any costs associated with arbitration. The award shall be final and binding upon the parties. Any award may be entered as a judgment or order in any court of competent jurisdiction.

Force Majeure. Neither Confetti nor Private Space Renter shall be liable or responsible for any delays or cancellations of the Private Party due to strikes, lockouts, casualties, acts of God, war, governmental regulation or control or other causes beyond the reasonable control of the Confetti or Private Space Renter.

These policies shall be governed by and construed in accordance with the laws of the District of Columbia. The Private Space Renter by making payment for the private space rental the rentee agrees has read and understands the aforementioned Private Space Rental Agreement and Regulations and agrees to abide by and be bound by such agreements and regulations.
